Despite its strange name, a quitclaim deed is a very important legal document. When you sell real property, a quit claim deed must be filed with the county in your state, transferring the property from the owner to the buyer, (the new owner.) Anyone with real estate will need one eventually.

In divorce situations, real estate necessitates a quit-claim deed. If one person is going to keep the home, the other person will need to "quitclaim" -- give up -- their portion of the home.

If you prepare a Living Trust or other estate planning tool (other than a Last Will & Testament,) you must transfer ownership of the real estate into the trust; to do so requires the use of a quitclaim deed.
